1. Acceptance of Terms

By engaging our painting services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

3.1 Estimates

  • All estimates are provided free of charge and are valid for 30 days from the date of issue
  • Estimates are based on conditions observed at the time of inspection
  • Final pricing may vary if conditions differ from those initially assessed

3.2 Written Agreements

  • All work will be performed under a written contract signed by both parties
  • Changes to the original scope of work must be approved in writing
  • Additional work beyond the original scope will be charged separately

4. Payment Terms

4.1 Payment Schedule

  • Payment schedules will be specified in individual contracts
  • Typical payment structure: deposit upon contract signing, progress payments during work, final payment upon completion
  • Payment is due within 30 days of invoice date unless otherwise specified

4.2 Accepted Payment Methods

  • Cash, check, or electronic payment
  • Credit card payments may be subject to processing fees

4.3 Late Payments

  • Late payments may be subject to interest charges of 1.5% per month or the maximum allowed by law
  • Work may be suspended for accounts more than 30 days past due

5. Client Responsibilities

5.1 Property Preparation

  • Client is responsible for removing or protecting personal belongings
  • Client must provide clear access to work areas
  • Client should relocate vehicles and outdoor furniture as needed

5.2 Property Conditions

  • Client must disclose known hazardous materials (lead paint, asbestos, etc.)
  • Client is responsible for ensuring adequate electrical supply for equipment
  • Client must provide access to water source if required

5.3 HOA and Permit Requirements

  • Client is responsible for obtaining necessary HOA approvals
  • Client must secure any required permits
  • Client must ensure color selections comply with HOA guidelines

6. Our Responsibilities and Warranties

6.1 Workmanship Warranty

  • We provide a [X]-year warranty on workmanship from the date of completion
  • Warranty covers peeling, cracking, or excessive fading under normal conditions
  • Warranty does not cover damage from acts of nature, accidents, or normal wear and tear

6.2 Materials

  • We use high-quality paints and materials appropriate for each application
  • Material warranties are provided by manufacturers
  • We will assist with warranty claims for defective materials

6.3 Licensed and Insured

  • We maintain current licensing as required by state and local authorities
  • We carry general liability insurance and workers' compensation insurance

7. Limitations of Liability

7.1 Property Damage

  • Our liability for property damage is limited to our insurance coverage
  • We are not responsible for damage to items not properly protected by the client
  • Pre-existing damage will be documented before work begins

7.2 Delays

  • We are not liable for delays caused by weather, client-requested changes, or circumstances beyond our control
  • Completion dates are estimates and may be adjusted due to unforeseen circumstances

7.3 Maximum Liability

  • Our total liability shall not exceed the total contract amount for the specific project

8. Cancellation and Changes

8.1 Client Cancellation

  • Client may cancel before work begins with written notice
  • Cancellation after work has commenced may result in charges for completed work and materials
  • Materials ordered specifically for your project may be non-refundable

8.2 Our Right to Cancel

  • We reserve the right to cancel contracts for non-payment, unsafe conditions, or breach of terms
  • We may suspend work for weather or safety reasons

8.3 Change Orders

  • All changes to original scope must be approved in writing
  • Change orders may affect project timeline and cost

9. Safety and Compliance

9.1 Safety Standards

  • We follow OSHA safety guidelines and industry best practices
  • Work areas will be secured to prevent unauthorized access
  • We use appropriate safety equipment and procedures

9.2 Environmental Compliance

  • We comply with all environmental regulations regarding paint disposal
  • Lead-safe work practices will be followed when required
  • Proper disposal of materials is included in our service

10. Intellectual Property

10.1 Color Consultations

  • Custom color schemes and design recommendations remain our intellectual property
  • Clients may use recommendations for the contracted project only

10.2 Photography

  • We may photograph completed work for marketing purposes
  • Client consent will be obtained before using images

11. Dispute Resolution

11.1 Mediation

  • Disputes will first be addressed through good faith negotiation
  • Unresolved disputes may be submitted to mediation before litigation

11.2 Governing Law
